Copyright and Personal Data Protection in Documents Hosted in the Cloud

Abstract

Storing all data in cloud could be described as a present-day phenomenon. It is very easy to recieve and share data in cloud with other users. Data are stored on remote server rooms and we can connect to them from anywhere provided that we have Internet connection. All we have to do is to enter a correct server address in the web browser and then log in using our username and password. This is also the principle on which the access to electronic information resources, e. g. university library, is based. In connection with quick and easy access to copyright protected material and other stored data is held a debate on security and copyright protection. Another point is protection of personal data located in the cloud storage. With using electronic information resources stored in cloud arise essential questions in the field of IT law and intellectual property law. What jurisdiction, for example, will govern a case of copyright infringement if the source is stored on a server in Dublin but its actual use occurs in the Czech Republic? Is it possible to store personal data coming from the Czech Republic on servers that are physically located outside the European Union? This article is based on experience with use of electronic resources at the University of Economics, Prague. Communication and information flow between students and teachers is provided by Office 365 from Microsoft. Teachers store their copyrighted materials that they want to provide to students on cloud service OneDrive and share them with students. Author's professional CV

Dipl.-Ing. Jitka Koubalíková is student of doctor program at the University of Economics in Prague, Faculty of International Relations, Department of International Trade. Her dissertation is focused on programs that deal with CRM in cloud. In the line of her doctoral studies she pursues mainly scientific research. She has published in several international peer reviewed journals. She usually deal with the topic of cloud computing and its implementation at universities. Jitka had the opportunity to try the process of implementation in practice, because at University of Economics in Prague she participated in the implementation of Office 365 as an unified communication system for both students and teachers. As a part of her doctoral studies, she lectures on several informatics courses focused on using office programs such as Microsoft Word, Microsoft Excel or Microsoft PowerPoint. For two years, she has been participating in operation of the University of the Third Age as a teacher of IT-focused courses and as a system integrator.
